1. Introduction & Acceptance of Terms
Welcome to Splurge Furniture. These Terms of Service (the “Terms”) govern your access to and use of the website located at splurgefurniture.com (the “Site”) and any purchases you make through it. The Site is operated by Splurge Furniture.
By accessing, browsing, registering for an account, or placing an order on the Site, you agree to be bound by these Terms and by our policies referenced within them, including our Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree with these Terms, please do not use the Site or place an order.
Please read these Terms carefully before using the Site. They contain important information about your rights and obligations, as well as limitations and exclusions that may apply to you.
2. Definitions
In these Terms, unless the context requires otherwise:
- “We”, “us”, and “our” refer to Splurge Furniture, the operator of the Site.
- “You” and “your” refer to the person who accesses the Site, registers an account, or places an order.
- “Site” means the website at splurgefurniture.com, including all pages, content, and functionality made available through it.
- “Products” means the furniture and related goods offered for sale on the Site.
- “Order” means a request you submit through the Site to purchase one or more Products.
3. Eligibility
To use the Site and place an Order, you must be at least 18 years of age, or the age of majority in your state of residence, whichever is greater, and able to enter into a legally binding contract. By using the Site, you represent and warrant that you meet these requirements and that the information you provide to us is accurate and complete.
If you are using the Site on behalf of a business or other entity, you represent that you are authorized to bind that entity to these Terms.
4. Account Registration & Security
You may browse the Site and place certain Orders without creating an account. If account registration is offered and you choose to create one, you agree to provide accurate, current, and complete information and to keep that information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly at Support@splurgefurniture.com if you suspect any unauthorized use of your account. We are not liable for any loss arising from your failure to safeguard your credentials.
5. Products, Descriptions & Availability
We work to keep Product descriptions, images, dimensions, materials, and other details on the Site accurate and current. Dimensions and measurements are provided for reference, and slight variations may occur in finished Products. Colors and finishes shown on the Site may vary slightly from the actual Product because of differences in display settings, screen calibration, lighting, and individual monitors.
Product availability is not assured. Items may sell out or be discontinued, and we may limit the quantities of any Product available for purchase. We reserve the right to modify, discontinue, or update Products and their specifications at any time without prior notice.
If a Product you ordered becomes unavailable after you place your Order, we will contact you and, where you have already been charged, issue a refund for the affected item.
6. Pricing & Payment
All prices on the Site are listed in United States Dollars (USD) and include any applicable taxes. The price shown is the price you pay, with no additional tax added at checkout.
Payments are processed through Stripe, a third-party payment processor. By submitting your payment details, you authorize us, through Stripe, to charge the total amount of your Order, including the Products and any applicable shipping charges, to your selected payment method. You represent that you are authorized to use the payment method you provide.
Despite our efforts, Products may occasionally be listed with an incorrect price or with typographical errors. We reserve the right to correct any pricing or other errors and to cancel any Order placed for a Product listed at an incorrect price, even after the Order has been confirmed. If your Order is canceled for this reason and you have already been charged, we will issue a refund of the amount charged.
7. Orders & Order Acceptance
When you place an Order through the Site, you are making an offer to purchase the Products in your cart subject to these Terms. The order confirmation email you receive is an acknowledgement that we have received your Order; it does not constitute our acceptance of your Order.
A binding contract is formed only when we accept your Order, which occurs when we dispatch the Products to you or otherwise confirm acceptance. We reserve the right to refuse, limit, or cancel any Order at any time, including after a confirmation email has been sent, for reasons that include Product unavailability, errors in pricing or Product information, or suspected fraudulent or unauthorized activity. If we cancel an Order for which you have already been charged, we will issue a refund of the amount charged.
8. Shipping & Delivery
We ship within the United States. Shipping methods, processing times, delivery estimates, and charges are described in our Shipping Policy, which is incorporated into these Terms by reference. Delivery time estimates are provided for planning purposes and are not assured. Risk of loss for Products passes to you upon delivery.
9. Returns & Refunds
Returns, exchanges, and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms by reference. Please review that policy for eligibility requirements, timeframes, and the steps to request a return or refund.
10. Order Changes & Cancellations
If you need to change or cancel an Order, please contact us as soon as possible at Support@splurgefurniture.com with your order number. We will make reasonable efforts to accommodate your request; however, once an Order has entered processing or has been dispatched, we may be unable to change or cancel it. In that case, the Return and Refund Policy will apply once you receive the Products.
11. Intellectual Property
All content on the Site, including text, graphics, logos, product images, page layouts, design elements, and software, is owned by or licensed to Splurge Furniture and is protected by United States and international intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own personal, non-commercial purposes. You may not copy, reproduce, republish, distribute, modify, scrape, data-mine, or otherwise reuse any content from the Site without our prior written permission. All trademarks, service marks, and trade names displayed on the Site are the property of their respective owners.
12. Acceptable Use & Prohibited Conduct
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree that you will not:
- use the Site in any way that violates any applicable federal, state, local, or international law or regulation;
- attempt to gain unauthorized access to any part of the Site, other accounts, or any systems or networks connected to the Site;
- use any robot, spider, scraper, or other automated means to access the Site or extract data without our written permission;
- introduce any virus, malware, or other material that is malicious or technologically harmful;
- interfere with or disrupt the operation of the Site or the servers and networks used to make it available;
- submit false, inaccurate, or fraudulent information, or impersonate any person or entity;
- use the Site to transmit unsolicited or unauthorized advertising or promotional material.
We reserve the right to suspend or terminate your access to the Site if we reasonably believe you have violated these Terms.

The Site may contain links to third-party websites or services that are not owned or controlled by us, and it relies on third-party services to operate, including Stripe for payment processing. We provide these links and services for your convenience and do not endorse and are not responsible for the content, policies, or practices of any third party.
Your use of third-party services, including Stripe, is subject to those parties’ own terms and privacy policies. We encourage you to review them. We are not responsible for any loss or damage arising from your dealings with any third party.
14. Disclaimers
The Site and the Products are provided on an “as is” and “as available” basis to the fullest extent permitted by applicable law. To the extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except as expressly set out in these Terms or required by law.
Where a manufacturer or seller warranty applies to a Product, the terms, duration, and coverage of that warranty are as stated in the documentation accompanying the Product or as required by applicable law. Nothing in these Terms is intended to limit or exclude any rights you have under consumer protection laws that cannot be waived.
We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, or that defects will be corrected.
15. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Splurge Furniture, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Site or the Products.
To the fullest extent permitted by applicable law, our total aggregate liability arising out of or related to these Terms or your use of the Site shall not exceed the amount you paid to us for the Product or Order giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
16. Indemnification
You agree to indemnify, defend, and hold harmless Splurge Furniture and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
17. Governing Law & Venue
These Terms and any dispute arising out of or related to them or your use of the Site are governed by the laws of the State of California, USA, without regard to its conflict-of-law principles. Subject to the Dispute Resolution section below, you agree that the state and federal courts located in California shall have venue over any matter not subject to arbitration.
18. Dispute Resolution
If a dispute arises between you and us, we ask that you first contact us at Support@splurgefurniture.com so that we can try to resolve the matter informally. Most concerns can be addressed quickly this way.
If we are unable to resolve a dispute informally within a reasonable period, the dispute shall be resolved through binding arbitration on an individual basis, or through the courts located in California, in each case to the extent permitted by applicable law. To the extent permitted by law, you and we agree that any dispute will be brought on an individual basis only, and not as a plaintiff or class member in any class or representative action. Nothing in this section prevents either party from seeking relief in small claims court where available, or limits any rights you have under applicable law that cannot be waived.
19. Severability & Entire Agreement
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and any other policies referenced on the Site, constitute the entire agreement between you and us regarding your use of the Site and supersede any prior agreements or understandings on that subject.
20. Changes to These Terms
We may update or modify these Terms from time to time to reflect changes in our practices, our Products, or applicable law. When we do, we will revise the “Last updated” date at the top of this page. Changes take effect when posted on the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
